Rental Agreement & Liability Waiver

Note: Signed consent with this agreement is required to confirm your picnic reservation.

Responsibility and Use & Disclaimer Warranties: You are responsible for the use of the rented items. You assume all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of and to pay, indemnity and will not hold Ethereal Events LLC responsible or accountable for damage, injury, or illness caused to you, your guests, any third parties, or properties resulting from the rental equipment or services provided by Ethereal Events LLC.

Code of Conduct: You agree that you and your guest(s) will conduct yourselves in an appropriate manner throughout the course of your picnic event. You agree that You will not engage in activity or behavior that:

  1. Violates the rules or codes of conduct of the picnic location, including excessive intoxication or consumption of alcoholic beverages when consumption of alcoholic beverages is expressly forbidden;

  2. Advertises or offers to sell any products, services, or solicits others (including solicitations for contributions or donations).

  3. Encourage or advocate illegal activity or the discussion of illegal activities with the intent to commit them, including drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity.

  4. Engages in behavior that is (a) defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms any person or entity. 

Equipment Failure: You agree to immediately discontinue the use of rented items should they at any time become unsafe or in a state of disrepair, and will immediately (thirty minutes or less) notify Ethereal Events LLC staff of the facts. 

Use of Equipment: Renter agrees to the proper and safe use of equipment. 

Equipment Responsibility: Renter is responsible for equipment from time of possession to time of pick up. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, damaged, renter will assume cost of replacement or repair. Renter shall pay a reasonable cleaning charge for rented items returned dirty beyond reasonable circumstances.

Deposit: Renter shall pay a 50% non-refundable deposit at time of reservation to confirm booking . Your reservation is NOT confirmed until we have verified the date availability, received your deposit, and this signed form. This fee is to reserve the rental and will be applied to the final cost. We do not accept cancellations and there are no refunds provided. We require, at least, 48hrs notice if you cannot enjoy your picnic event on the date and time you reserved. We will work with you to reschedule for the earliest date that works for you and us within a 3mth duration and your deposit will be applied to the new reservation. If you do not notify us of the need to reschedule your picnic within 48hrs of your reserved date or simply choose not to reschedule, all payments received will be lost.

Balance Payment: Renter agrees to pay the balance due for their reservation 72hrs prior to the reservation date. If the balance due is not paid on time, the reservation will be cancelled. and no service will be provided, nor will rescheduling be offered.

Care of Equipment: In addition to other obligations hereunder, renter shall: Protect the rented items from damage, breakage, unauthorized or improper use, theft or loss while in possession of renter.

Site Preparation: If picnic tent will be setup on private property, renter agrees to have site cleaned and ready for delivery and installation.

Permits & Licenses: Renter agrees prior to any installation of rental tent and equipment, to obtain at renters expense, any and all necessary permits, licenses, and any other consent required.

Fines & Tickets: Renter agrees that Ethereal Events LLC is not responsible for any fines or tickets issued due to the behavior or actions of renter, or their guest(s), during the duration of their picnic event.

Hold Harmless Agreement: Renter agrees all risk and agrees not to hold Ethereal Events LLC and any of its staff responsible for and from any and all claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectly for or relating to; the delivery, installation, dismantling, and use of rented equipment.

Damage Waiver: Any loss or damage due to theft, misuse or abuse, intentional damage, mysterious disappearance or other loss due to failure to care for the rented items will result in a replacement fee for any equipment that is damaged. We charge a replacement fee of half the value of the item when purchased, depending on the value of the damaged item.

Image Release: Ethereal Events LLC reserves the right to use photographs that have been taken of your picnic event and shared on social media or forwarded to us in our promotional materials and/or website.
